Florida’s Pool Barrier Law: Necessary Requirements
The minimum requirements to ensure safety and security are established by the Florida Residential Swimming Pool Safety Act (Section 515.29) and include the following:
- Height should be at least 4 ft for measurement from the outside
- The barrier should be smooth without any footholds on the first 45 inches
- The barrier should not lead to any openings or footholds for the child to gain access
- The barrier should not have any gaps for the child to crawl through
- The barrier should be different from the backyard fence but it must conform to regulations the same way as the backyard fence
If the pool does not comply with the requirements of the given legislation, there are other alternatives offered by the state, such as the use of a safety cover, an alarm that produces sound not less than 85 decibels for doors leading to the pool, and self-latching devices on doors leading to the pool and a pool alarm to detect the entry of someone inside.
The Most Common Cause for Refusing The Inspection
Sometimes we come across examples of beautiful glass barriers failing inspection because of the placement of some items around the barriers, which makes it easier to climb. A patio bench against the glass. A planter box below a panel. Pool steps allow a child’s foot to touch the top rail. None of this is a problem regarding the glass. It is a problem of everything outside of it, and it is the first thing we look for before we give a quote for a job. Move it away or it always fails, no matter how well the installation is done, because that check protects children and pets.
